Our third presentation was from Alistair Byrom on issues regarding retaining walls and encroachments.
The presentation was a discussion of current Queensland legislation as it relates to encroachments, trespass and improvements on or near a boundary and how the Queensland Court may approach such situations.
The Survey Mapping and Infrastructure Act 2003 establishes the survey standards, the Development Approval process under the Planning Act 2016 can, in some circumstances, dictate the position of a retaining wall However it is the Property Law Act 1974 that defines an encroachment and offers the Court powers to grant relief in respect of an encroachment.
The Court, however, may choose an alternative approach to what may seem like a straightforward encroachment matter. As relief to an encroachment is limited by legislation. Considering how the Court may choose to address a boundary dispute, Alistair will discuss what are a surveyor’s professional responsibilities regarding encroachments and retaining walls.
Alistair has worked on numerous projects in across Queensland in his career. Prior to joining Veris, he was Managing Director of a well-respected Brisbane based firm Goodwin Midson.
Alistair has an affinity with land law, as it relates to surveying and this has led to forensic consulting in which he has prepared numerous Expert Reports for the Supreme Court, Land Court and the Planning & Environment Court.
Alistair has an active role on many advisory committees, including the local and National Chairman for SIBA and is currently on the SSSI Qld Regional Committee. In 2015 he was awarded a SIBA Chair Award for Service to Industry and in 2016 was awarded a Fellow of SSSI.
